DMCA / Copyright Policy

Athletes Club, LLC ("Athletes Club," "we," "us") respects the intellectual property rights of others and expects users of our platform to do the same. This policy describes how we handle copyright complaints under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

1. Designated DMCA Agent

Send notices of claimed copyright infringement to our designated agent:

File the same agent information with the U.S. Copyright Office at dmca.copyright.gov so the designation is effective under 17 U.S.C. § 512(c). Until that filing is complete, treat this page as our public intake channel and send notices to dmca@athletesclub.app.

2. How to submit a takedown notice

A valid notice must include all of the following (17 U.S.C. § 512(c)(3)):

1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner. 2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by one notice. 3. Identification of the material that is claimed to be infringing, and information reasonably sufficient for us to locate it (for example, the public URL, facility name, and a description of the file or listing). 4. Your contact information: name, mailing address, telephone number, and email address. 5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. 6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Incomplete notices may be delayed or rejected. Do not send only a screenshot or a social-media message.

3. Counter-notification

If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notification to the same agent. A valid counter-notification must include (17 U.S.C. § 512(g)(3)):

1. Your physical or electronic signature. 2. Identification of the material that was removed or to which access was disabled, and the location where it appeared before removal. 3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification. 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or for any judicial district in which Athletes Club, LLC may be found if your address is outside the United States), and that you will accept service of process from the person who provided the original notification or that person's agent.

If we receive a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant files a court action seeking to restrain you.

4. Repeat infringers

We may terminate accounts of users who are repeat infringers in appropriate circumstances, consistent with 17 U.S.C. § 512(i).

5. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages.
